1. Overview
Welcome to The Kobold Guild.
These Terms of Service (“Terms”) govern your use of The Kobold Guild website, our online store and the products and services offered through it.
Throughout these Terms, “The Kobold Guild”, “we”, “us” and “our” refer to The Kobold Guild and its proprietor. “You” and “your” refer to any visitor, customer or other user of the website.
By accessing our website, creating an account or placing an order, you agree to these Terms together with any policies referred to within them.
Nothing in these Terms excludes or limits any statutory consumer rights that cannot legally be excluded.
The Kobold Guild is based in the United Kingdom. We welcome customers internationally and recognise that customers in other countries may benefit from mandatory consumer protections under the laws applicable to them.
2. Access and Accounts
You may browse most areas of our website without creating an account. Where account functionality is available, you are responsible for providing accurate information and keeping your login details secure.
You are responsible for activity carried out using your account unless that activity occurs through no fault of your own. You must notify us if you believe your account has been accessed without permission.
If you are not old enough to enter into a legally binding contract in your country, purchases must be made or authorised by a parent, guardian or other person legally able to enter into the contract. We may suspend or restrict an account where reasonably necessary because of fraud, security concerns, misuse of the website or a serious breach of these Terms.
3. Our Products
The Kobold Guild may sell or provide:
- original and commissioned illustrations;
- custom digital artwork;
- downloadable maps;
- digital TTRPG books and supplements;
- printed books;
- prints and merchandise;
- physical products;
- products manufactured or fulfilled by third-party production partners; and
- other creative goods and services.
Individual product pages may contain additional information about specifications, formats, dimensions, licences, turnaround times, revisions, fulfilment or permitted uses. That information forms part of your purchase agreement where applicable.
We try to represent products accurately. However, colours may vary slightly depending on screens, printing methods, materials and manufacturing processes. Handmade, artist-created and independently manufactured products may also contain small natural variations that do not amount to defects. Your statutory rights regarding goods, services and digital content remain unaffected.
4. Orders
By placing an order, you are offering to purchase the selected products or services in accordance with these Terms.
You must provide accurate and complete information when ordering.
We will provide confirmation of your order electronically.
We reserve the right to refuse or cancel an order before it has been accepted where there is a legitimate reason, including suspected fraud, an obvious pricing error, product unavailability, inability to fulfil the requested commission, or where fulfilling the order would be unlawful.
If we cancel an order after payment has been taken and no lawful deduction applies, the relevant payment will be refunded.
Once a binding contract has been formed, we will not cancel or materially alter it simply because we have changed our mind.
Custom commissions may also be subject to a commission brief or other agreed specifications. Once accepted by both parties, those agreed specifications form part of our contract.

5. Prices and Billing
Prices are displayed in the currency shown on the website.
Applicable taxes will be included in the displayed price or calculated and clearly presented during checkout where required.
Delivery charges and any other mandatory charges payable to us will be displayed before you complete your purchase.
For international orders, customs duties, import taxes or local handling charges may apply. Where these charges are not collected by us at checkout, they may be payable separately by the recipient.
You are responsible for providing accurate billing and payment information.
We do not add optional paid extras without your express agreement.
UK online-selling rules require customers to be shown the total price, delivery costs and payment obligations before placing an order.
6. Shipping and Delivery
Delivery options, estimated fulfilment times and shipping charges will be displayed where applicable.
Some physical products are produced and shipped directly by The Kobold Guild, while others may be manufactured and fulfilled by one of our production partners.
Where a third-party manufacturing partner fulfils your order, The Kobold Guild remains the seller with whom you placed your order, unless clearly stated otherwise.
Delivery dates are estimates unless we have expressly agreed that a particular date is essential. We will make reasonable efforts to deliver within the stated timeframe and within any period required by applicable consumer law.
UK distance-selling rules generally require goods to be delivered within 30 days unless another delivery period has been agreed. Delays may occasionally occur because of postal services, customs, manufacturing disruption or circumstances outside our reasonable control. This does not affect any legal remedies you may have where delivery is unreasonably delayed.
Returns and failed deliveries are dealt with under our Return and Refund Policy.
7. Intellectual Property
Unless expressly stated otherwise, all original artwork, illustrations, characters, graphics, designs, maps, written material, TTRPG material, photographs, branding, website graphics and other original creative content displayed or sold by The Kobold Guild are protected by applicable intellectual property law.
Copyright and other applicable intellectual property rights remain with The Kobold Guild and/or the individual creator identified as the rights holder.
Purchasing a physical or digital product does not transfer ownership of its copyright.
Purchasing commissioned artwork also does not transfer copyright unless a separate written copyright assignment expressly states otherwise.
Customers receive only the usage rights or licence specified in the relevant product description, commission agreement or commercial licence.
Unless your licence expressly permits it, you may not:
- reproduce our work commercially;
- resell or redistribute digital files;
- manufacture merchandise using our artwork;
- claim our work as your own;
- remove copyright or attribution notices for the purpose of misrepresenting authorship;
- commercially licence our work to another person;
- create or distribute unauthorised copies; or
- otherwise exploit the work outside the licence granted to you.
Nothing in this section prevents use that is expressly permitted by applicable copyright law.
UK copyright protection arises automatically for original artistic and literary works, including illustrations and web content.
8. Artificial Intelligence and Machine Learning
Our use of generative AI
Artwork sold or presented as artwork by The Kobold Guild is human-made.
The Kobold Guild does not use generative artificial intelligence to create the illustrations or artistic content contained in our finished artwork or printed creative works.
Where artwork is identified as being created by The Kobold Guild, it has been created by a human artist.
Use of our work with AI
Our artwork and other copyright-protected creative works are not licensed for generative AI training, machine-learning training, dataset creation or synthetic-content generation.
Unless you have received our prior written permission, you may not upload, submit, reproduce, scrape, extract, process or otherwise make our protected creative works available to a third-party artificial intelligence or machine-learning system for purposes including:
- model training;
- fine-tuning;
- dataset creation;
- image generation;
- image-to-image generation;
- style imitation;
- embeddings or model development;
- automated content generation;
- commercial text or data mining; or
- creation of derivative synthetic datasets.
This restriction applies whether the material was purchased, commissioned, downloaded or accessed publicly through our website.
Purchasing artwork from us does not grant permission to use it for AI training or generation.
Any unauthorised use will be treated as an unauthorised use of our intellectual property and a breach of any applicable licence or contractual terms. Where such use involves acts restricted by copyright law, we reserve the right to pursue remedies available for copyright infringement.
Nothing in this section overrides a use that we are legally required to permit under a mandatory copyright exception.
EU reservation of rights
To the fullest extent permitted under applicable EU law, The Kobold Guild expressly reserves its rights in relation to text and data mining of its copyright-protected works, including under Article 4 of Directive (EU) 2019/790.
EU law expressly allows rights holders to reserve rights against the general text-and-data-mining exception and specifically contemplates machine-readable reservations for content publicly available online.
9. Optional Tools
We may provide access to tools, applications or functionality supplied by third parties.
Examples may include payment services, product customisation tools, review systems, accessibility tools or other Shopify applications.
We do not control every aspect of those services.
Your use of a third-party tool may also be governed by the provider's own terms and privacy policy.
Where we choose or integrate a third-party service as part of fulfilling our obligations to you, nothing in this section removes responsibilities that applicable consumer law places upon The Kobold Guild.
10. Third-Party Links
Our website may contain links to third-party websites, platforms or services.
These may include social networks, marketplaces, payment processors, manufacturers or other external resources.
A link does not necessarily constitute endorsement of everything offered or stated on that website.
Third-party websites operate according to their own terms and privacy practices, and you should review those terms before using them.
We are not responsible for independent third-party websites that we do not operate or control, except where applicable law provides otherwise.
11. Relationship with Shopify
Our online store is hosted using Shopify.
Shopify provides the ecommerce technology that enables us to display products, process orders and operate our online store.
Unless expressly stated otherwise, your contract for products purchased from this store is with The Kobold Guild, not Shopify.
The Kobold Guild is responsible for the products and services sold through this store, including fulfilment, returns, customer service and applicable consumer-law obligations.
Shopify itself states that stores using its services remain responsible for their goods and services and that the contract of sale is directly between the merchant and customer.
Your use of certain Shopify-provided functionality, such as Shop Pay, may also be subject to Shopify's own applicable terms.
12. Privacy Policy
Your privacy is important to us.
Our collection and use of personal information is explained in our separate Privacy Policy.
Depending on your location, your personal information may also be protected by legislation including the UK GDPR, Data Protection Act 2018 and EU GDPR.
Please review our Privacy Policy before submitting personal information through the website.
13. Feedback
We welcome reviews, suggestions and general feedback about The Kobold Guild.
Unless otherwise agreed, ordinary feedback submitted to us is not confidential and we may use it to help improve our website, products and services.
This does not mean that we claim ownership of artwork, original characters, manuscripts, commission references or other creative materials you provide to us for the purposes of an order.
Rights relating to customer-supplied creative material remain with their respective rights holders.
You must only provide material that you own or have permission to supply to us for the intended purpose.
14. Errors, Inaccuracies and Omissions
Although we take reasonable care when maintaining our website, occasional typographical errors, technical mistakes or outdated information may occur.
We may correct errors or update website information at any time.
Before an order has been accepted, this may include correcting an obvious pricing or product-description error.
Once a binding contract has been formed, we will not simply impose a materially different product or increased price on you because an error was discovered.
Where a material error prevents us from reasonably fulfilling an accepted order, we will contact you and provide the options available under the circumstances, which may include cancellation and a refund.
15. Prohibited Use
You must not use our website or its contents:
- for unlawful or fraudulent purposes;
- to infringe another person's intellectual property rights;
- to distribute malware, malicious code or harmful software;
- to interfere with the security or operation of the website;
- to attempt unauthorised access to another user's account;
- to impersonate another person or organisation;
- to make fraudulent purchases or payment disputes;
- to harass, threaten or abuse others;
- to collect personal information unlawfully;
- to circumvent technical protections;
- to reproduce or commercially exploit website content without permission; or
- to use our protected creative works for prohibited AI or machine-learning purposes described in Section 8.
Reasonable indexing by ordinary search engines and other uses authorised by us are not prohibited by this section.
We may restrict access where we reasonably believe these Terms have been seriously breached.
16. Agents and Relationship Between the Parties
Nothing in these Terms creates a partnership, employment relationship, joint venture or agency relationship between you and The Kobold Guild.
You do not have authority to make commitments or representations on our behalf.
Third-party manufacturers, delivery companies and service providers may act as contractors involved in fulfilling an order, but their involvement does not automatically make them the seller of products purchased from The Kobold Guild.
17. Termination
You may stop using our website at any time.
We may suspend or terminate access to website accounts where reasonably necessary because of serious or repeated breaches of these Terms, fraud, unlawful conduct or security concerns.
Termination of website access does not automatically cancel an existing accepted order.
Any outstanding rights and obligations relating to orders, payments, intellectual property, licences, liability or other matters intended to survive termination will continue where appropriate.
Nothing in this section affects statutory cancellation or consumer rights.
18. Disclaimers and Warranties
We aim to keep our website accurate, secure and available but cannot promise that the website itself will always operate without interruption or technical errors.
Temporary maintenance, technical faults or events outside our reasonable control may occasionally affect availability.
Nothing in these Terms excludes warranties, guarantees or other rights that apply automatically under consumer law.
In particular, we do not seek to exclude legal requirements relating to goods being as described and of satisfactory quality, digital content conforming to the contract, or services being performed with reasonable care and skill.
UK consumer law prohibits businesses from using contractual wording to remove these statutory protections.
19. Limitation of Liability
Nothing in these Terms limits or excludes liability where doing so would be unlawful.
In particular, nothing excludes or limits liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation; or
- statutory consumer rights that cannot legally be excluded or restricted.
For customers acting as consumers, we are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed, except where the law provides otherwise.
Where you purchase primarily for business purposes rather than as a consumer, different rules may apply and any separate commercial agreement or licence entered into between us may contain additional liability terms.
The Consumer Rights Act specifically prevents businesses from excluding liability for death or personal injury resulting from negligence and restricts unfair attempts to exclude other consumer liabilities.
20. Indemnification and Responsibility for Misuse
If you use our website or intellectual property unlawfully, you remain responsible for the consequences of your actions.
To the extent permitted by law, you may be responsible for reasonable losses, costs or claims directly caused by your deliberate unlawful conduct or serious breach of these Terms.
We will not seek to impose an indemnity or financial obligation on a consumer where doing so would be unfair or contrary to applicable consumer law.
If you are acting in the course of a business, you agree to indemnify The Kobold Guild against reasonable third-party claims arising directly from material you supplied to us where you did not have the necessary rights or permission to use that material.
21. Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will apply only to the extent legally permitted.
Where possible, the remainder of the Terms will continue in effect.
22. Waiver and Entire Agreement
If we do not immediately enforce a right under these Terms, that does not mean we have permanently waived that right.
These Terms, together with:
- the relevant product description;
- our Return and Refund Policy;
- any accepted commission brief;
- any specific licence supplied with a product; and
- other terms expressly agreed between us
form the agreement applicable to your purchase.
Nothing in this section excludes statements or information that applicable consumer law treats as binding upon us.
23. Assignment
You may not transfer an order or contractual licence to another person where the product or licence is specifically personal to you, unless we agree otherwise.
We may transfer our rights or obligations as part of a legitimate sale, restructuring or transfer of the business, provided doing so does not reduce your legal rights.
Where notification or consent is required by law, we will comply with those requirements.
24. Governing Law
These Terms and contracts with The Kobold Guild are governed by the laws of England and Wales, except where mandatory consumer law provides otherwise.
If you are a consumer living elsewhere in the United Kingdom, European Union or another jurisdiction, you may also benefit from mandatory consumer protections provided by the laws of your country of residence.
Nothing in these Terms is intended to remove rights relating to the courts or dispute-resolution procedures available to consumers under applicable mandatory law.
25. Headings
Headings are provided for convenience and readability only.
They do not affect the interpretation of these Terms.
26. Changes to These Terms of Service
We may update these Terms occasionally to reflect changes in our business, services, website or applicable law.
The current version will be published on this page together with its latest revision date.
Changes will generally apply from the date the updated Terms are published.
We will not use a later version of these Terms to retrospectively remove rights or materially alter the terms of a purchase already agreed with you, except where required by law or expressly agreed with you.
